Petition Your State's Government to Reaffirm 10th Amendment

CALL TO ACTION:

On April 9th Texas Gov. Rick Perry joined state Rep. Brandon Creighton and sponsors of House Concurrent Resolution (HCR) 50 in support of states rights under the Tenth Amendment to the U.S. Constitution.

The Tenth Amendment states:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

In his speech Gov. Perry states “I believe the federal government has become oppressive. I believe it has become oppressive in its size, its intrusion in the lives of its citizens, and its interference with the affairs of our state.”

The Freedom Factory is launching a campaign to get every state government to adopt comparable legislation, reaffirming their legitimate rights within the context of a free American Republic.

We need to spread the word, to mobilize residents from every state in the Union to remind our public servants that we will not tolerate erosion of our rights and the Constitution that guarantees them.

Here’s a sample letter you are urged to send every public servant in your jurisdiction. Send this to your state’s governor and state legislatures, and leave a comment below to sign our petition:

The federal government has grown too big and too powerful, infringing upon the legal sovereign rights of our state affirmed by the Tenth Amendment to the U.S. Constitution. There is a resurgent federalist movement best highlighted by the Texas Legislature that I want implemented in [list your state]. The Texas legislature will soon be voting on House Concurrent Resolution (HCR) 50 that reaffirms state sovereignty. We need similar legislation in our state.

No one in Washington D.C. knows how to run our state better than our own residents. I am tired of our government bowing to federal authority. I demand that we reassert our right to self governance. I urge you to do all you can to support this movement and regain control of our state from Washington D.C.

The residents of this state need you to protect them from a growing central government. I hope that you have the courage to stand up for those to whom you are responsible.

Here’s a great resource for finding the names and contact information for your elected representatives. Take a few minutes to cut and paste the sample letter into an e-mail and let these lawmakers know we mean business. Enough is enough!

I’m here today to offer my unwavering support to the millions of Texans that are tired of Washington D.C. trying to come down here and telling us how to run Texas.

The 10th Amendment was enacted by folks who remembered what it was like to have a very repressive government, to be under the thumb of tyrants and an all powerful government. Unfortunately, the protections it guarantees have melted away over the course of the years.

You’re prob familiar with that old adage of how to boil a frog: You just get him to sit there in that pot and you turn up the heat a little bit by a little bit, before you know it the frog doesn’t realize it, but he’s done.

And since the U.S. constitution has been ratified the federal government has been slowly turning up the heat, and they’ve eroded the notion of states rights.

Texans know best how to govern Texas. We’re proof that good things happen when government lowers taxes, and lowers regulations, it reduces spending and encourages private sector growth.

I happen to believe that the constitution does not empower the federal government to overrule state laws without restraint. I agree with Texas’s 7th governor, Sam Houston, who said “Texas has yet to learn submission to any oppression, come from what source it may.”

I believe the federal government has become oppressive. I believe it has become oppressive in its size, its intrusion in the lives of its citizens, and its interference with the affairs of our state.

Purpose of the 2nd Amendment

With all the controversy over legislating gun laws it is worth revisiting why the 2nd Amendment exists:

Dr. Suzanna Gratia had both of her parents executed in a 1991 massacre along with 21 other people in a Texas restaurant. A gunman plowed his pickup truck through the restaurant window and then opened fire with a Glock 17 pistol and later a Ruger P89. Gratia’s father charged the gunman and was mortally wounded by a shot to the chest. His wife refused to flee and crawled over to her husband of 47 years at which point she was shot in the head while cradling her husband’s body.

Dr. Gratia relates that she had a pistol less than 100 yards away in her car, but due to concealed weapons laws in Texas at the time, was not allowed to carry the firearm on her person. Without that law, she says, her parents and dozens of others in that restaurant could have survived.

Addressing the Texas legislature, Dr. Gratia dismisses some common beliefs that firearms are intended for sport, and says why the 2nd Amendment really exists:


“I’m not going to make very many friends saying this, but it’s about our rights, all of our rights, to be able to protect ourselves from all of you guys up there.”

The text of the Second Amendment:

A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.

This is a statement relinquishing the federal government from the ability to regulate weapons. There is controversy over interpretation-many feel as though the term “militia” implies that the federal government has authority to regulate firearms amongst individuals, but not state militias.

The purpose of the law is to restrict the federal government from regulating weapons, period. Militias were, and in many cases are, comprised of individuals who retain their own weapons. The intent of the law is to restrict federal authority and provide a check on power-the people are supposed to maintain the right to physically remove federal authority should they find it unacceptable.

At the time of the creation of the law states maintained full sovereignty, exercising greater latitude of authority than the federal government. It was never envisioned that states would be subordinate to the central authority. Now they are.

After the civil war beat states into submission, and nearly an hundred years of accepting federal handouts, states no longer retain comparable authority to limit federal power. The final check on the central bureaucrats has always been, and still remains, the people. As such, it is perverse to think the federal government has the right to disarm its populace.

In order to remain free, a people must have the right to self-armament with weapons that are at least comparable to that which federal troops possess.

Obama Wants $634 billion for Socialized Health Care. President Obama is calling on Congress to appropriate $634 billion for a health care “reserve fund” aimed at reforming the system and providing care for 46 million Americans who are currently not insured.

Obama Wants Higher Taxes on Wealthy to Pay for Health Care. President Obama intends to propose additional tax increases on the affluent to pay for his promise to make health care more accessible and affordable. This will be done by calling for stricter limits on the benefits of itemized deductions taken by the wealthiest households. Also in the mix to fund health care, are proceeds from carbon cap-and-trade permits businesses must buy when they exceed pollution thresholds.

House Passes New spending Bill, Another $410 billion. The House of Representatives passed a $410 billion omnibus spending bill packed with pet projects requested by both Democrats and Republicans. This comes a week after President Obama signed a $787 billion spending bill to “fix” the economy. Spending on domestic programs increased 8% for the current fiscal year, with critics pointing to myriad pork lines totalling $8 billion for more than 8,500 projects. These include such ridiculous items as $1.7 million for a honey bee lab in Texas, $346,000 for research on apple fire blight in Michigan and New York, and $1.5 million for work on grapes and grape products, including wine. Can this get any more ridiculous?

U.S. Government Virtually Takes Over Student Loan Market. The federal government has quietly increased funding in the student loan market to such a large degree that many wonder if there still remains a role for private investors. The U.S. government has committed hundreds of billions to purchase loans directly and make additional guarantees in the secondary market for student debt instruments.

State Department Accuses China of Human Rights Abuses. The U.S. State Department issued a report on the state of human rights around the world, which singled out China for numerous violations. It accused China of stepping up “severe cultural and religious repression” of minorities, as well as increasing its detention and harrassment of dissidents. Ironically, this comes just after Secretary of State Hillary Clinton told China that these issues would take back burner to pressing economic relationships, including a call for the Chinese to continue buying U.S. Treasury securities.
